Terms of Service

1. What Fonetix provides

Fonetix is an online Romanian-language learning platform for adults, with a curriculum aligned to CEFR levels A1–A2: theory lessons, exercises, a sounds library, automated pronunciation feedback, exams and certificates.

Pronunciation feedback and exam scoring are automated. We do not guarantee any particular result, any particular language level, or that you will pass an exam taken elsewhere.

2. Your account

• You can create an account yourself, on an individual subscription, or be enrolled by your employer or agency, who then pays the subscription for you.
• Your login details are personal. Do not share them; you are responsible for activity in your account.
• You must be at least 16 to create an account yourself.
• The information you give at registration must be true and current.

3. If your employer enrolled you

Where an employer or agency pays for your subscription, they can see your progress, learning time, exam results and identity-verification status, as described in the Privacy Policy.

Your access to the curriculum depends on their subscription staying active: if it ends, access is suspended. Your account and progress remain yours and can be moved to another employer using a transfer code.

4. Identity verification

Some features — exams and certificates in particular — require identity verification (KYC) and a facial liveness check. These involve processing biometric data on the basis of your explicit consent; see the "Biometric Data" notice.

Without that consent you can still use the curriculum, but you cannot obtain an identity-verified certificate.

5. Pricing, billing and payment

• The list price is €50 per learner per month. During launch pricing a discount is applied automatically at checkout, bringing it to €20 per learner per month. We will let you know before the price changes.
• Subscriptions are monthly and renew automatically until cancelled.
• Payments are processed by Stripe, and fiscal invoices are issued through Oblio.
• Prices are stated in euro; VAT is applied as the law requires.
• For companies and agencies, billing is per occupied seat — that is, per active learner — per month.

6. Cancellation and right of withdrawal

• You can cancel at any time. Cancellation takes effect at the end of the period already paid for; until then you keep access. We do not refund part of a period already started.
• If you are a consumer in the European Union, you have the right to withdraw from the contract within 14 days of entering into it, without giving a reason (Romanian GEO no. 34/2014).
• If you ask us to begin supplying the service within those 14 days and then withdraw, you owe the value of what you used up to the point of withdrawal.
• If your employer pays for your subscription, they are the ones who cancel it; amounts invoiced to them cannot be refunded to you.

7. Certificates

Certificates attest that you completed the Fonetix curriculum, are aligned to CEFR levels A1–A2, and are tied to an identity verified through KYC and a facial liveness check.

They are not diplomas issued by a public authority and do not replace an official language exam, where a third party requires one.

Issuing a certificate requires at least 6 paid subscription months for that learner within the trailing 6-month window.

8. Acceptable use

The following are not allowed. We may suspend or close an account that breaches these terms, particularly in cases of exam fraud.

• Do not use anyone else’s account, and do not let anyone else sit your exams.
• Do not attempt to bypass identity verification, access limits or security measures.
• Do not copy, resell or redistribute the course content.
• Do not upload unlawful material or material that infringes the rights of others.

9. Intellectual property

The Fonetix curriculum, texts, audio recordings, exercises, brand and software are ours or licensed to us. You receive a personal, limited, non-transferable right to use them for the duration of your subscription, solely for your own learning.

10. Availability

We work to keep the platform available, but we do not guarantee uninterrupted or error-free operation. We may carry out maintenance, change features, and discontinue features, giving notice in advance where the change is significant.

11. Liability

We do not limit liability for fraud, gross negligence, personal injury, or anything else the law does not allow us to limit.

Otherwise, our total liability to you is limited to the amounts paid for the service in the preceding 12 months.

12. Personal data

How we handle your data is described in the Privacy Policy, the "GDPR" page and the "Biometric Data" notice, which form part of these terms.

13. Changes to these terms

We may update these terms. Where a change is significant we will tell you through the platform or by e-mail before it takes effect. If you do not agree, you can cancel your subscription.

14. Governing law and disputes

These terms are governed by Romanian law. Disputes go to the competent courts at our registered office, without affecting any right the law gives you as a consumer to bring proceedings where you live.
